TERMS AND CONDITIONS OF USE

The terms “Erizo”, “us”, “we”, or “our” refer to Erizo Baby Slings Ltd. (“Erizo”). The term “you” or “your” refers to the user of our website or purchaser of our products.

1. Not a Safety Device 

The Erizo Baby Sling is not a safety device. The baby slings are designed to assist you in carrying your baby. You agree that you are wholly responsible for the safety of your child while you are using or attempting to use the sling.

2. Product Instructions 

Any safety guidelines, product instructions or product demonstrations, including diagrams, photos and videos on our website are for informational purposes only and you agree to not rely on them. You are solely responsible for the proper use of the baby sling. You further indemnify and release Erizo from any claims, actions, losses, demands, disputes, expenses and liabilities that may result from your reliance on any safety guidelines or product instructions or demonstrations on our website.

3. Transaction of Business 

You agree that the use of Erizo’s website does not constitute the transaction of business in any province, state or jurisdiction other than Alberta.

4. Product Availability 

The completion of any product purchase transaction will be subject to availability of the product you order. Erizo will endeavor to have all products available but will not be held responsible for any delay in delivery of a product due to unavailability.

5. Product Suitability 

Erizo does not represent or warrant that our products will be suitable for your desired, intended or actual use.

6. Payments 

You agree to pay the listed price for any product purchased, including applicable taxes. You represent and warrant that all credit information you supply is accurate and complete and that any purchase transaction is subject to the approval of your credit card payment.

7. Refund and Return Policy 

You agree to contact us at admin@erizobabyslings.com within 10 business days of receiving your product if you have any product complaints or concerns. Keep in mind that all of our baby slings are handmade, and done with custom colours. If the product had a flaw that was missed in quality control, we will be happy to send you a replacement or refund your purchase, once you return the defective product.

8. Privacy

Erizo will not sell or provide any personal information provided to us by you to any third party.

9. Indemnification

You agree to indemnify, release and hold harmless Erizo and Erizo’s agents, officers, directors, employees, contractors, subcontractors, suppliers, successors, assigns ( collectively the “Indemnified Parties”) from any claims, actions, losses, demands, disputes, expenses, and liabilities that may result from your purchase, use, misuse, or attempted use of our product. This indemnity will include all legal and enforcement costs that the Indemnified Parties may incur, on a full indemnity solicitor client basis. You further agree to defend any such claim against the Indemnified Parties at your cost, but at Erizo’s choice of, and direction to counsel.

10. Use of and Purchase from this Website

Erizo does not warrant that this website, its services or emails sent from Erizo are free of viruses or other harmful components. You agree that Erizo will not be liable in any way for any loss, injury, claim, liability, or damage of any kind resulting in any way from any errors in or omissions from the website or any products purchased via this website, the unavailability or interruption of the Website or any features of this website, your use of the website, or receipt of emails from Erizo.
